Terms of service

These terms are an agreement between the business that opens an Omega CS account ("you") and Source Digital, Perth, Western Australia ("we", "us"). By creating an account or using the service you accept them.

The service

Omega CS is a customer relationship management service with an AI assistant that replies to enquiries, a mobile number for text messaging, connections to Facebook, Instagram, email and accounting providers, and tools for quotes, jobs and invoices. We may improve or change features over time; we will not remove a core capability you are paying for without reasonable notice.

Your account

  • You must be authorised to act for the business you register, and you are responsible for the people you invite.
  • Keep your login details secure and tell us promptly about any unauthorised use.
  • You must give accurate details at sign-up, including a valid business name and contact information.

Your customers' data and the law

  • You are responsible for the information you put into the service and for having the right to collect and use it, including your customers' contact details.
  • You must comply with the Spam Act 2003, the Do Not Call Register Act 2006 and the Privacy Act 1988 when messaging people. The service records opt-outs and stops messaging a number that replies STOP; you must not work around that.
  • If you connect a Facebook Page, ad account or another provider, you confirm you are entitled to do so and you accept that provider's terms.

The AI assistant

The assistant writes replies based on the instructions, pricing notes and documents you give it. It is a tool acting for you; you are responsible for what is sent from your account. Review its setup, keep its instructions current, and take over any conversation that needs a person. It never confirms bookings without a connected calendar and never names a price you have not given it, but it can make mistakes, and it should not be relied on for legal, safety or financial advice.

Trial, fees and cancellation

  • New accounts get a 14-day free trial with a fixed allowance of AI and text-message usage. No payment details are needed to start. When the trial ends or the allowance is used, the assistant pauses until a plan is chosen.
  • Plans are billed monthly in advance in Australian dollars, plus GST, by direct debit or card through Stripe. Each plan includes a usage allowance for AI and text messages sized for its tier; we will tell you before anything pauses if you exceed it.
  • You can change plans or cancel at any time from the billing page. Cancellation takes effect at the end of the current billing period; there are no refunds for partial months.
  • We may change prices with at least 30 days' notice by email.

Acceptable use

Do not use the service to send unsolicited bulk messages, to harass or deceive anyone, to collect information you have no right to, to interfere with the service or other customers, or for anything unlawful. We may suspend an account that does.

Your data

Your data stays yours. You can export it at any time and it is deleted within 90 days of closing your account, except records we must keep by law. How we handle personal information is set out in our privacy policy.

Availability and support

We aim to keep the service available around the clock and to fix faults quickly, but we do not guarantee uninterrupted service; providers we depend on, such as messaging and AI networks, can have outages. Support is by email at sales@source-digital.com.au.

Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Otherwise, to the extent the law allows, our total liability for any claim connected with the service is limited to the fees you paid in the three months before the claim, and we are not liable for indirect loss such as lost profits or lost business, or for the content of messages sent from your account.

Ending the agreement

You can close your account at any time. We can end it with 30 days' notice, or immediately if these terms are seriously breached or the account is not paid.

Law

These terms are governed by the laws of Western Australia, and disputes go to its courts.
